How much does an executor get paid in Florida?
Short answer
Florida presumes a personal representative’s fee is reasonable at 3% of the first $1 million, 2.5% from $1 million to $5 million, 2% from $5 million to $10 million, and 1.5% of everything above $10 million.
On a $500,000 estate that is $15,000.

The Florida fee schedule
| Portion of the estate | Rate |
|---|---|
| $0 – $1,000,000 | 3% |
| $1,000,000 – $5,000,000 | 2.5% |
| $5,000,000 – $10,000,000 | 2% |
| Above $10,000,000 | 1.5% |
What counts toward the fee
The base is the compensable value: the inventory value of the probate estate plus income earned during administration. Assets that pass outside probate — joint accounts, payable-on-death accounts, life insurance to a named beneficiary — do not count.
With two personal representatives on an estate of $100,000 or more, each is entitled to the full commission. With more than two, the commission for two is split among them.
Worked examples
| Estate value | Executor fee | Effective rate |
|---|---|---|
| $250,000 | $7,500 | 3% |
| $500,000 | $15,000 | 3% |
| $1,000,000 | $30,000 | 3% |
| $2,000,000 | $55,000 | 2.8% |
One personal representative. Include income earned during administration in the value.
Taxes and waiving the fee
Yes. An executor commission is taxable income to the executor. An inheritance generally is not, which is why an executor who is also a beneficiary often waives the fee.
No. Executors can decline the commission. Whether waiving makes sense depends on whether the executor is also a beneficiary and on their tax situation — check with the estate’s attorney.
